Kindergarten logic. Right up there with "hands up, don't shoot" (that didn't happen) and "I can't breathe" (that was a drug overdose).

Removing the 'Good attempted to kill the agent' factor .. was attempting to leave the scene sufficient justification to fire three shots at Good? In another situation a man (George Floyd) died while being restrained (by Dererk Chauvin) but the similarity ends there because Chauvin didn't fire three shots into Floyd's head.

"Attempt" implies intention, which is impossible for the officer to divine in the moment, hence irrelevant.
The similarities are that one attempted to evade arrest and the other resisted arrest. One evaded in a way that caused the perception of immediate danger (justified self-defense) to the officer, and the one resisted in a way that (along with the angry crowd) prolonged getting medically checked out.
Justified self-defense is a legal doctrine that allows individuals to use reasonable force to protect themselves (or others or property, depending on the jurisdiction) from an imminent threat of unlawful physical harm. It serves as a complete defense in criminal and tort law, meaning that if the actions are found to be justified, the person is absolved of criminal responsibility. The officer believed he faced "immediate and unavoidable danger of physical harm, death, or serious bodily injury." That belief was reasonable because, as I've shown, similar situations have resulted in death within one second. The SUV's wheels spun and engine revved pointing directly at him. As I've shown, a vehicle gunned at someone that close can lead to death, hence lethal force being proportional to the perceived deadly threat. The officer did not initiate the attack. All the legal criteria for justified self-defense met.

Quote:The officer believed he faced "immediate and unavoidable danger of physical harm, death, or serious bodily injury." Might explain the first shot, if we assume he didn't see her cutting the steering wheel to the right which is clear on his own cellphone recording. But it doesn't explain the two extra shots into her face thru her open window when he was well out of harm's way. The only explanation for that is rage for her trying to get away. Pure hate-driven murder. And hence his immediate pronouncement after he finished her off "Fucking Bitch!". |
