  • The majority of ICE arrests during the Obama administration (and up until 2025) actually happened at the border, away from the public eye.

  • Some unauthorized migrants were taken into ICE custody while in prison or jail, not out in the streets.

  • When "at large" migrants did have to be tracked down and arrested (similar to today), they were precisely targeted, with a lot of vetting of the individual's criminal history taking place before the teams went out. They were laser-focused and quietly constrained, not trying to grab everyone up in the open.

  • Border patrol agents uprooted from their normal environment are not trained to deal with aggressive protesters and chaotic situations in cities, and the spotlight of the latter.

"Lowell called Lemon's arrest an "unprecedented attack on the First Amendment" and said the journalist "will fight these charges" in court.

Lowell had said last week that a magistrate judge rejected charges against Lemon, and a source told ABC News that Bondi last week was "enraged" at the magistrate judge's decision to not charge the journalist.

Minnesota Chief U.S. District Judge Patrick Schiltz also wrote to the 8th Circuit appeals court last week that Lemon and his producer were “not protesters at all,” and that “[t]here is no evidence that those two engaged in any criminal behavior or conspired to do so.”

‘No Precedent’: Fed Judge Denies Minnesota Injunction To Stop ICE Surge

The judge also found that the plaintiffs had not shown that the balance of harms decisively favored issuing an injunction.

A federal judge on Saturday denied Minnesota Attorney General Keith Ellison’s request for an injunction to halt the Trump administration’s immigration enforcement surge in Minnesota, finding the case did not justify extraordinary judicial intervention.

U.S. District Judge Katherine M. Menendez, a Biden appointee, wrote that Ellison and lawyers for St. Paul and Minneapolis had asked the court to extend existing precedent to the point of novelty, noting in her order that “none of the cases on which they rely have even come close.”
