There has to be a limit so that
1/Soldiers and sailors can sleep at night knowing they did what had to be done without becoming monsters.

No, actively engaging in criminal activity is literally what makes you a criminal. Even if never caught or tried. Happens all the time.
Conflating the presumption of innocence in a court of law with what actually happens out in the real world is just naive.

Nope...you only committed a crime if you are prosecuted of it in court. Criminal is thus a legal definition.
