Guess what, the Portland PD have finally been allowed to do their jobs in the meantime. So since Oregon and Portland didn't like the last ruling, they changed the facts on the ground, having PPD tear down antifa tents on the sidewalks near the ICE facility, and then requested an en banc hearing from the full panel of judges. They could have let the PPD do their jobs from the beginning, but that just demonstrates that Democrats are much more interested in politics than enforcing existing laws in a fair, unbiased manner.

"Portland police spokesperson Mike Benner said the protest camp had become a focal point of the area surrounding the ICE facility and that there had been a “noticeable increase in fights, antagonistic behavior, and other illegal activity” at the site.

“Given the heightened intensity and level of criminal activity observed, the Portland Police Bureau recommended to the mayor’s office that an emergency abatement be conducted to vacate and clean the area,” Benner said. “Ultimately, this decision was made in the best interest of everyone involved to reduce the risk of harm, restore public safety and encourage a change in behavior moving forward.”

On Monday, more than 50 people enjoyed a calm and lighthearted atmosphere outside the ICE building in South Portland. “Craftivists” were back at their yarn table to teach people how to crochet, and a Latin Dance Protest offered free dance lessons."

According to news reports covering the encampment outside the Immigration and Customs Enforcement (ICE) building in Portland, police didn't clear the area sooner for a mix of reasons, including legal constraints, a less aggressive enforcement strategy by the city, and the need to differentiate the protest from standard homeless encampments. The camp was ultimately cleared in October 2025 after a change in police tactics.

"A federal judge in Oregon on Friday issued a permanent injunction barring the Trump administration from deploying the National Guard on the streets of Portland in response to protests against the president's immigration policies.

"This Court arrives at the necessary conclusion that there was neither 'a rebellion or danger of a rebellion' nor was the President 'unable with the regular forces to execute the laws of the United States' in Oregon when he ordered the federalization and deployment of the National Guard," U.S. District Judge Karin J. Immergut, who was appointed by President Donald Trump in his first term, wrote in her ruling.

The Trump administration can appeal the ruling if it wants to.

Oregon Gov. Tina Kotek responded to the ruling Friday, calling Trump's move to federalize the guard "a gross abuse of power."

"Oregon National Guard members have been away from their jobs and families for 38 days. The California National Guard has been here for just over one month. Based on this ruling, I am renewing my call to the Trump Administration to send all troops home now," Kotek said.

California Attorney General Rob Bonta, whose justice department argued in the case objecting over his state's National Guard's deployment, called the decision "a win for the rule of law, for the constitutional values that govern our democracy, and for the American people."

The White House did not immediately respond to a request for comment on the ruling."
