1st Law 'given a makeover'

Hot on the heels of widespread nonsensical theorizing re BH-DE 'connections', a mystical craziness wave seems to be expanding in other directions:

"Developed in the 1850s, the first law of thermodynamics is only valid for systems in which a temperature can be properly defined, a state known as equilibrium. As an example, when combined, a cup of cold water and a cup of hot water will eventually reach a warm temperature between them. This warm temperature is the equilibrium. However, when the hot and cold water have not yet reached that endpoint, the water is out of equilibrium."

What??!!. Validity of 1st Law has nothing to do with thermal content being near or far from equilibrium. Being perhaps hard to measure is not the same as claiming 'doesn't apply'.
(A widely accepted extremely diffuse nonlocal exception to validity of 1st Law is for an expanding universe - Noether's theorem and all that.)
