Wisconsin Statutes 941.20 (1)c

(1)  Whoever does any of the following is guilty of a Class A misdemeanor:

...

c.  Except as provided in sub. (1m), intentionally points a firearm at or toward another.

where (1m) concerns pointing a firearm at law enforcement officers, paramedics or firemen, which is a felony in Wisconsin law.

There doesn't appear to be any exception to this law for people who believe that their firearm isn't loaded.

Anyone who has ever visited a shooting range knows that rule #1 of firearm safety is to treat every firearm as if it was loaded and never point it at anyone else. Alec Baldwin recently demonstrated why that's so.

Yep, even though the magazine was removed, the bolt is closed (on a possible live round) and his finger is on the trigger. But leftist morons don't know the four simple rules of gun safety.

1. Watch that muzzle!
Keep it pointed in a safe direction at all times.

2. Treat every firearm with the respect due a loaded gun.
It might be, even if you think it isn't.

3. Be sure of the target and what is in front of it and beyond it.
Know the identifying features of the game you hunt. Make sure you have an adequate backstop—don’t shoot at a flat, hard surface or water.

4. Keep your finger outside the trigger guard until ready to shoot.
This is the best way to prevent an accidental discharge.


And apparently the prosecution's final hail Mary was to say Kyle pointed his gun at someone for a second, without shooting, and that was provocation precluding a self-defense defense.
So anyone in that courtroom would be justified in trying to kill Binger, according to his own arguments in court.
